Minimum Advertised Price Policy

IMPACT CBS has adopted the following MINIMUM ADVERTISED PRICE (“MAP”) to best serve the interests of our Dealers/Resellers. This MAP policy is designed to: (1) ensure that desirable pre-sales and post-sales services and infrastructure can be provided by our channel partners; (2) support the Impact brand as a premium offering; (3) avoid end consumer market confusion.  This MAP policy has been established unilaterally by IMPACT to help ensure the legacy of IMPACT as a leader in providing high quality recreational watersports products and accessories and to protect the reputation of it’s name and products.  IMPACT reserves the to modify, amend and cancel this MAP policy at anytime for any reason.

This MAP policy covers all IMPACT distributors, dealers and retailers, (“Resellers”) located in the United States.  All Resellers advertising IMPACT branded products in all forms of media defined below are subject to this MAP policy.  MAP pricing for products covered under MAP are provided to each Reseller on the 2021 price sheet.  Access to MAP pricing is available at all times on the IMPACT website.  “Dealer Network.”  IMPACT reserves the right to change the MAP for any product, at any time and for any reason.

The Map policy applies to all advertisements of IMPACT products in any and all media, including, but not limited to, flyers, posters, coupons, mailers, inserts, newspaper, magazines, catalogs, mail order catalogs, email newsletters, email solicitations, internet or similar electronic media, television, radio, and public signage. The MAP policy is applicable to all internet advertised prices.  An internet advertised price is defined as the price for a product show on a we browser search, Resellers homepage, content on a webpage within the Resellers site or domain, or if the Reseller is conducting e-commerce through a third party site or domain, contents on third party sites or domains.  This MAP policy also covers internet auctions that display or have reserved bids or other acceptable prices below the MAP.  The MAP policy is not applicable to any in-store advertising that is displayed only in the store and not distributed to customer(s) via one of the aforementioned media.

The MAP policy does not establish maximum advertised prices.  All resellers may advertise IMPACT products at any price in excess of the MAP.

The MAP policy applies only to advertised prices and does not apply to the price at which the products are actually sold or offered for sale to an individual consumer within the Resellers location or over the telephone.  IMPACT Resellers remain free to sell these products at any price they choose.  IMPACT does not seek, nor will it accept, any agreement or understanding with respect to the prices you may advertise or charge at any time.

 

IMPACT MAP policy does not in any way limit the ability of any Reseller to advertise that “they have the lowest prices” or, they “will meet or beat any competitors price.” That the consumer should “call for a price” or phrases of similar import as long as the price advertised or listed for the products is not less than the MAP.

Reseller agrees to hold all trademarks of IMPACT as property of IMPACT and use advertising materials provided by IMPACT in an authorized manner only.
